135 euros fine for breach of confinement

Prime Minister Edouard Philippe has announced that the lump sum fine of 38 euros will rise to 135 euros for non-compliance with the confinement rules as of Wednesday, March 18, 2020. It may also be increased.

This Monday, March 16, Emmanuel Macron announced stricter containment measures following the spread of the new Coronavirus, Covid-19.

According to the decree put in place on the day of the president's speech, it is prohibited to leave your home except for travel related to professional activity when teleworking is impossible, individual physical activity or the needs of pets as well as those for essential purchases, for health reasons or compelling family reasons. All people leaving their home for these different reasons must have a derogatory travel certificate, signed and dated on the day of the release in question. This is essential, regardless of the duration of the trip.

This decree came into force on Tuesday March 17 from noon. The government announced that the fine for violating the confinement rules was 38 euros if you left your home without proof. Many police and gendarmes, mobilized by the Minister of the Interior, arrested several passers-by without their certificate, but did not always punish them. However, the police will not hesitate to do so as of Wednesday, March 18. In addition, the fine will be much higher. Indeed, government spokeswoman Sibeth Ndiayne said tickets would be put in place "very quickly" to ensure compliance with movement rules to combat the spread of the virus, Covid-19.

An increase in the fixed fine

Prime Minister Edouard Philippe said thatfrom this Wednesday, "the fixed fine will increase to 135 euros" stating that it could be increased. A decree published on March 18 in the Official newspaper effectively confirms a flat-rate ticket of 135 euros with an increase reaching 375 euros in case of unauthorized movement. This measure will be effective "at once". "The decree creates a 4th class contravention in the event of a violation of the prohibitions or in the event of a breach of the obligations laid down", details the text.

The people sanctioned will be those who leave their home for a reason other than those provided for by the decree but also those who move without the "document allowing them to justify that the displacement considered falls within the scope of one of these exceptions". As a reminder, the honor certificate may be downloaded from the Ministry of the Interior website or handwritten on plain paper. Initially, it could be presented on a smartphone. However, the government finally backed down by specifying that only paper documents were valid.

Containment not always easy to respect

Travel regulations to fight the spread of Coronavirus radically change the lives of French people. Many find it difficult to respect it. After the decree entered into force, some passers-by were arrested without their honor certificate. People without a printer admitted that the text was long to copy by hand, others tried to negotiate with the police because it is generally difficult to get into this new habit.

While the tension was palpable in the streets, exchanges with the authorities were sometimes far from courteous. Some have taken on a whole new dimension. The video of a woman coughing and spitting on police officers, shared on Twitter by journalist Simon Louvet, toured the web and outraged Internet users. "It is all over France that this person spits", "Inadmissible behavior", could we read in particular on social networks.

This woman, approached by three police officers, refused to apply the rules of containment. "Leave me, I have the coronavirus, you will have it too!", she launched to the police, equipped with masks and gloves.

Simon Louvet then explained that "the woman was released after being checked. The police are exhausted, everywhere small groups continue to wander and taunt the officials. They keep calm, but are disillusioned: "They don't understand anything, incredible".

From now on, the police will be intransigent in the face of the violation of containment measures, valid until March 31, 2020 and which can be renewed.
