15-year-old victim – shared private sex video with friends


Nowadays, the cell phone is always with you – apparently for some even during sex! He and his ex-girlfriend recklessly sent a short video that was produced in the process, showing the defendant (19) with a 15-year-old. This earned the young duo a court date and a conviction.

The offense accused is called the pornographic depiction of minors. Right at the beginning, the Unterland apprentice emphasized that the suggestion to make a video of the mutual love game came from the 15-year-old herself. “Strange, then why did you only film five seconds?” The victim representative smelled a clandestine filming. Because of subsequent psychological impairments, he demanded 2000 euros in compensation for pain and suffering for the girl. This was then also awarded.

Defendant blames the “ex”
Previously, the defendant described the version that not he, but his second-accused ex-girlfriend (19) had put the slippery video in a WhatsApp group. From his cell phone, she also had his access codes. This didn’t seem believable, after all, the relationship between the two had already ended. But because the “ex” had also distributed the video from her own cell phone, each was fined 1440 euros (half of which was conditional).

Made with consent?
The 19-year-old was acquitted of having made the video because the court was unable to refute the victim’s initial consent. The forwarding, however, was criminally relevant. “You are unlucky that the technology enables the exact evaluation of all processes on a cell phone,” said judge Andrea Steffan.
