The 76-year-old probably had several opportunities to touch and observe the girl in an inappropriate manner in the absence of his wife from May 2017 to March 2022. He spied on the now 13-year-old in the bathroom, and at the beginning of the incident he also spoke to the 7-year-old about intimate shaving. There is said to have been repeated touching of the chest and vaginal area. Responsibility as a supervisor “Both grandparents looked after the child,” said judge Norbert Hofer, meaning that the defendant was a trustworthy and, above all, supervisor. At the beginning of the year, the man was sentenced to twelve months in prison – nine of them conditionally – in the course of the case. However, the Supreme Court (OGH) partially overturned this. Now the punishment was even higher at 18 months (six unconditional). Due to the overturning of the guilty verdict due to abuse of authority, only this charge was heard. The conviction for sexual abuse of minors had already been legally binding.
