Air France-KLM: appeal against the annulment of Brussels’ approval of state aid


(AOF) – Air France-KLM and Air France confirm having filed two appeals for annulment before the Court of Justice of the European Union (CJEU) of two judgments rendered in December 2023 by the General Court of the European Union annulling two decisions of the Commission of 2020 and 2021 “approving several state aid measures granted by France during the Covid-19 crisis”. Air France-KLM “recalls” that the two companies “have reimbursed all of the aid received, in accordance with the applicable legal framework”.

The Court of Justice of the European Union announced on December 20, 2023 that its court annulled the decisions of the European Commission approving financial aid from France in favor of Air France and Air France-KLM during the health crisis . Seized by Ryanair and Malta Air, the court considered that the Air France-KLM holding company and KLM “were likely to benefit, at least indirectly, from the advantage granted by the State aid in question”.
