AirBNB: appeal to the Council of State against the government’s refusal to remove the tax loophole


(AOF) – Senator LR Max Brisson announced on furnished tourist accommodation. The finance law adopted and promulgated contained the “anti-AirBNB” amendments aligning the tax rate on tourist rentals with that of bare rentals, but the executive applied in the public finance bulletin the law prior to this finance law.

“What justifies this refusal to apply the provisions of a democratically passed law?” asked Senator LR on March 6 during an exchange at the Palais du Luxembourg with the Minister Delegate in charge of Housing Guillaume Kasbarian.

“This excess of power of the government which decides to disregard this provision and maintain the taxation rules as if no amendment had been adopted, will also be attacked before the administrative justice”, announces the communist group in the Senate (CRCE -K).
“It is no longer acceptable that Airbnb-type tourist accommodation, which increases the difficulties of access to housing for residents, reinforces real estate speculation on housing, and dismantles access to public services, benefits from tax incentives in relation to long-term housing” adds the group.
