The allegations against AfD politician Daniel Halemba are serious: the public prosecutor’s office is investigating, among other things, sedition. The 22-year-old is arrested and the Bavarian state parliament lifts his immunity. However, Halemba does not have to be behind bars for the time being – he will be released under conditions.

According to the public prosecutor’s office, the Würzburg district court has suspended the arrest warrant for the AfD politician Daniel Halemba under certain conditions. This was preceded by investigations by the public prosecutor’s office against the 22-year-old for incitement to hatred and the use of symbols of anti-constitutional organizations. Halemba now has to report to the police at his home in Würzburg once a week, said senior public prosecutor Thorsten Seebach. He is also prohibited from contact with members of the “Teutonia Prag zu Würzburg Fraternity”.

An arrest warrant was issued against Halemba last Thursday, and this morning police officers arrested him in Kirchheim unter Teck near Stuttgart. According to the public prosecutor’s office, the investigators’ initial suspicions were confirmed after the evaluation of evidence and there was a risk of blackout. If there is a risk of blackout, there is a fear that the accused could influence witnesses or destroy evidence.

State parliament lifts Halemba’s immunity

According to his own information, Halemba has been a member of the “Brschenschaft Teutonia Prag zu Würzburg” since 2021, which was raided in September. The investigators suspected that there could be objects in the fraternity’s fraternity house with symbols of the National Socialist Party, NSDAP, as well as stickers and writings of a racist nature. Almost all of the seized items have now been evaluated, said the spokesman for the public prosecutor’s office. “The allegations have been confirmed for us.” The evaluation of data carriers is still ongoing. In addition to Halemba, the public prosecutor’s office is investigating four other members of the student association.

Halemba had so far rejected everything as false. The 22-year-old was elected to the state parliament on October 8th. Members of parliament generally enjoy immunity. However, the state parliament repealed Halemba’s immunity in its constituent session. At the end of today’s meeting, all parliamentary groups except the AfD voted in favor – without State Parliament President Ilse Aigner mentioning his name in the public meeting. The AfD parliamentary group abstained.
