Assistance: the disability compensation benefit extended to people with mental disabilities


Eligible people will be able to benefit from human assistance to support their “global autonomy”, from January 2023.

From January 2023, people with an intellectual disability will be able to benefit from human assistance to carry out certain acts of daily life, such as shopping or administrative procedures, the government announced on Wednesday.

A decree published on Wednesday in the Official Journal widened the criteria giving right to the “Disability compensation benefit(PCH) so that this aid can be granted to people with a psychic, mental, cognitive disability or a neurodevelopmental disorder. Human aid may be granted if the person has difficulty “manage stress” in the face of the unexpected or to carry out “multiple tasks» of daily life, such as the successive tasks necessary to prepare a meal (preparing food, cooking), according to the decree.

A long-awaited reform

Eligible persons will be able to benefit from human assistance to support their “overall autonomy(help with shopping, taking transport, participating in life in society, etc.). The device was tested last year in three departments: the Ardennes, the Gironde and the Vosges, specifies a press release from the services of the Secretary of State for Persons with Disabilities, Sophie Cluzel.

This reform had been demanded for a long time by the associations representing the persons concerned and their families: according to them, the criteria for allocating the PCH – which since 2005 has made it possible to finance human aid for certain daily activities – de facto excluded persons with mental disabilities. To benefit from it, until now, the person had to be unable to carry out essential daily activities on their own, such as washing, dressing, going to the toilet, eating, moving about in their accommodation.

However, many people with a psychic handicap are not hampered for these daily gestures but for other steps – shopping, going to the doctor, taking the bus… – for which they were not entitled until ‘now to no help.
