A few weeks ago, Federal Interior Minister Faeser announced that she intended to tighten the laws on deportations. Her ministry is now presenting a series of proposals. According to this, detention should be extended and violations of entry and residence should be punished more severely.

The Federal Ministry of the Interior has submitted proposals to increase the number of deportations. Detention should therefore be extended from the current ten to 28 days. In addition, violations of entry and residence bans should become an independent reason for detention. According to the Ministry of the Interior, these and other measures are now to be discussed with the federal states and local authorities. After that, the legislative process will begin.

With the submission of the discussion draft, the ministry implemented the demands of the Prime Ministers’ Conference with Chancellor Olaf Scholz in May. According to the information, all measures required in the decision at that time are included in the paper. Ordering and continuation of detention pending deportation should therefore also be possible independently of any asylum applications.

More relief for social authorities

Objections and legal action against entry and residence bans should no longer have a suspensive effect. And when searching for people who are obliged to leave the country, it should be easier for the police to enter other areas in shared accommodation than just the room of the person concerned.

Another draft for discussion is about improved data transmission to immigration and social authorities. In the future, the Central Register of Foreigners (AZR) will also contain information on whether those affected receive subsistence benefits, which authority is responsible for granting them and over what period of time the benefits are granted. Foreigners and benefits authorities such as social welfare offices and job centers should be relieved by eliminating manual queries about social benefits.
