Derek Chauvin (45) was found guilty in the death of George Floyd († 46) – but now he wants a new trial. His attorney, Eric Nelson, has filed a new trial for ex-police officer Chauvin.
Nelson justified the motion, according to CBS, with misconduct on the part of the jury and with the fact that the court had abused its discretion because it had not approved the defense’s motions to change the venue.

What jury misconduct is it? The retry motion comes amid a discussion over a photo of juror Brandon Mitchell. It shows him at a demonstration in Washington last August, at which George Floyd’s relatives also spoke.
You can see him wearing a T-shirt that says “Get Your Knee Off Our Necks”. On his jury questionnaire, Mitchell wrote that he had not participated in any protests against police brutality.

Derek Chauvin found guilty
On April 20, the jury in Chauvin’s trial found him guilty on all three counts of second degree murder, third degree murder and second degree manslaughter.
Since the verdict was pronounced, the judge in the murder trial, Peter Cahill, has been advising the length of the sentence. (euc)
