Following the publication by the CryptoLeaks site of compromising videos on the lawyer, Kyle Roche had already taken the necessary steps to withdraw from the cases in progress against the crypto giants. However, this withdrawal did not concern his office, the legal process was only to continue without his intervention.

Kyle Roche and Ava Labs in the turmoil of a scandal

This individual withdrawal will therefore not extinguish the fire. After listing the points of contention, the lawyers for Tether and Bitfinex raise “serious concerns for the B/T Defendants”, regarding the motivations underlying the class action against its customers, the purposes of this proceeding, and the how it will be conducted.

They reminded the judge of the essential points that are at the source of the current scandal, which is shaking Kyle Roche and his cabinet:

  • the videos would prove – the conditional is in order – the fact that the lawyer has “ a huge turnout in Ava Labs, and that it would file lawsuits against other companies in the industry, with the aim of “harming Ava Labs’ competitors”.
  • Kyle Roche also reportedly made “several disparaging remarks about juries,” the band members involved in the class action, and the class action process in the United States.

False allegations or credible evidence: the legal battle does not wait

Kyle Roche and the CEO of Ava Labs, Emin Gün Sirer, had refuted these allegations, and no judge has yet pronounced until today, on the veracity or not of these damning videos. Lawyers for Tether and Bitfinex, however, a good shot to playand don’t want to let this opportunity slip through their fingers.

Even if the plaintiffs do not give up in the event of a forced withdrawal of the firm Roche Freedman which represents them, such an event would probably slow down the proceedings, and could also play in favor of the defendants during the trial.

In addition to requesting a takedown order against the firm, Tether’s and Bitfinex’s lawyers are further demanding that Kyle Roche and Roche Freedman Roche LLP “certify to the court” that they have indeed ” returned or destroyed all documents and information produced by the Defendants in this lawsuit”.

The request also aims to ensure that the respondents have not “shared these documents or information with Ava Labs or any other third party”.

Avalanche is mired, rightly or wrongly, in this dirty business. Ava Labs will have to do a lot more than just deny it if it wants to quickly put an end to a scandal, which in reality shouldn’t have happened.
