Because of neighbor criticism – court does not judge: local must pause

Burger King and St. Pölten – somehow that doesn’t really fit. After two failed attempts in the past, the third restaurant in the state capital is now closed. However, only temporarily and for a curious reason: A neighbor’s complaint ensures that the grills stay cold.

A neighbor of the branch on Mariazeller Strasse was already worried about noise, smell and traffic before construction began in 2019. He lodged a complaint against the first-instance approval for the construction and operation of the fast-food restaurant. This ended up in the state administrative court. And it’s still there. The curious consequence: the three-year period for operation without a legally binding permit has now expired. On Friday, the closure had to be pronounced by the magistrate as the first instance. “Incredible inactivity” operator TQSR is beside himself. “We deeply regret that we have to temporarily close due to the incredible inaction of the state administrative court. A decision should have been made after six months at the latest. Claims for damages are being examined. According to the state administrative court, after an oral hearing about a year ago, an expert opinion was requested, which is currently still with the official expert.
