Bernard Tapie’s widow will have to pay more than 15 million euros to the tax authorities

Dominique Tapie, widow of Bernard Tapie, will have to pay to the French tax administration the more than 15 million euros in tax arrears and penalties claimed from her, after the non-admission of her appeal by the Council on Monday of state.

Dominique Mialet-Damianos contested two tax notices issued in September 2017 asking him to pay respectively some 2.675 million in arrears of income tax charged to the Tapie lice for the years 1989, 1990 and 1991, and 12.746 million euros for the years 1992, 1993 and 2016, as well as the payment of housing tax for the year 2016, and the corresponding penalties.

As Ms. Mialet-Damianos’ appeal was not admitted, the decision of the highest French administrative court is final. The widow of the former minister and businessman, who died in October 2021, will therefore have to pay a total of approximately 15.422 million euros.

The tax administration had been seeking for thirty years to obtain the recovery of tax arrears from the Tapie couple, but had been prevented from doing so due to the placement in judicial liquidation, in December 1994, of the businessman and his wife.

In July 2015, the Paris Court of Appeal ruled that Dominique Tapie was, unlike her husband, no longer in a situation of compulsory liquidation, thus opening the possibility for the tax administration to claim the sums due.
