Bonduelle: sanctioned by the competition authority

The Competition Authority has sanctioned three professional canning organizations, FIAC, ADEPALE and ANIA, and the can manufacturers’ union, SNFBM, for having implemented a collective strategy aimed at preventing manufacturers from the sector to compete on the question of the presence or absence of bisphenol A in food containers (cans, cans, etc.). Eleven companies, prosecuted as members of these organizations, were also sanctioned, the cumulative amount of sanctions reaching nearly 20 million euros.

The Competition Authority notified complaints to 101 companies in 2021 for an agreement not to communicate on the presence or composition of certain materials in contact with foodstuffs, to the detriment of consumers. These entities are notably accused of having concealed the presence of Bisphenol A in their packaging.

Bonduelle faces a fine of 2.884 million euros. As TP ICAP Midcap (‘retain’) explains, this amount is significant but will have only a limited impact on the group’s financial metrics. The sanction could obviously harm the group’s image even if the grievance dates back to the 2010s. Andros, Charles et Alice, Cofigeo, Conserves France, D’Aucy, General Mills, Unilever, Ardagh, Crown and Massilly are the other companies condemned.
