In a statement on Tuesday, the authorities announced that they were taking legal action to bring the stadium home early. In concrete terms, this means that they are preparing to take the Swissporarena away from Stadion Luzern AG – and with it Alpstaeg.

The reason for the legal action is that not everything was processed correctly when transferring shares in Stadion Luzern AG in 2018 and 2019. “During the sale, the shares were offered to the city of Lucerne, but not to FCL Holding AG,” says Lucerne Mayor Beat Züsli. This violates the building contract. The ground on which the Swissporarena stands belongs to the city. The Stadion Luzern AG built the football stadium under construction law.

Board of Directors not properly staffed

The city council also pointed out that the administrative board of Stadion Luzern AG was no longer correctly composed. “The building contract actually stipulates that a representative from FCL Holding AG must be present. That’s not the case at the moment,” explains Züsli.

The city council became aware of the irregularities in the contract at the end of June. Stadion Luzern AG was subsequently asked to show how the shares were transferred in detail with regard to the purchase rights. “So far we have not received this information,” says Züsli. They only received a copy of a letter in which it was stated that Stadion Luzern AG did not consider FCL Holding AG to be entitled to purchase rights. That is why the shares were not offered to her for purchase.

That’s not enough for the Lucerne city council; it has to assume that “there is a serious violation of the building contract.” “In order to protect public interests and legal rights, the city council has therefore decided to trigger the early reversion,” the statement says. That would probably lead to a legal battle lasting years. The authorities note that they remain willing to talk.
