Six people from different parties lodged a complaint against the transfer. They have applied to the Federal Court to annul the cantonal council’s so-called preservation decision of May 8, 2023 regarding Isabel Garcia and to declare a violation of political rights. In addition, the matter should be referred back to the cantonal council for a new decision.

Change after the deadline

With the preservation decision, the cantonal council confirmed the results of the Zurich renewal election. The results were published in the cantonal official gazette. The five-day deadline to take legal action expired on February 22nd. The following day it became known that Garcia had informed the GLP of her defection to the FDP on the same day.

When preserving the election results on May 8, 2023, AL and the Greens requested that Garcia not be confirmed because she had violated good faith. This “vote of no confidence” failed with 107 votes to 52 and eleven abstentions. With Garcia’s change of party, the so-called Climate Alliance in the Zurich Cantonal Council (with SP, GLP, Greens, EVP and AL) lost its wafer-thin majority of one vote.
