Chalon: fourth assizes in the same rape case

She was attracted to me. She still is by the way“: the Assize Court of Saône-et-Loire began, on Monday, the trial of a fifty-year-old who is appearing for the fourth time at the assizes for the rape of a woman in 2012, which he continues to deny .

Abdelkrim Mouina, now 54, was sentenced by the Doubs Assize Court in 2018 to eight years’ imprisonment, accused of raping a woman, on May 30, 2012 in Boussières (Doubs), close to Besançon. The accused appealed but the Jura Assize Court increased the sentence, sentencing him to twelve years in prison in October 2019.

“She was also attracted to me”

Abdelkrim then appealed in cassation and obtained in 2020 the cancellation of his conviction on the grounds that “the accused was unable to make his case“. New assizes, this time in Côte d’Or, again increase her sentence, in June 2021, bringing her to fifteen years in prison. But Abdelkrim Mouina again contests this verdict and the Court of Cassation cancels it once again and he is therefore tried for a fourth time at the assizes, this time in Chalon-sur-Saône. “I am innocent, ma’am“, repeated at the bar the accused, addressing the president Céline Therme. “She could see very well that I was interested in her. She too was attracted to me. She still is by the way“, assured the accused, who appears free after being released on August 24, 2022 after four years in pre-trial detention.

Victim of several rapes

Abdelkrim Mouina, followed in psychiatry since 2002 and already sentenced in 1986 by the Assize Court for minors to 10 years’ imprisonment for gang rape, only admits having caressed the victim over his clothes and having rubbed against her until to orgasm. Traces of his sperm will be found on the dress. The victim, she speaks of a digital and penile penetration which made her sink into depression and alcoholism. She had already been the victim of a rape the year of her 16 years. Abdelkrim Mouina faces 30 years of criminal imprisonment, given the state of recidivism. The trial is scheduled to last until Wednesday.
