Insurance problem

Faced with this disaster, the 53-year-old bachelor – who was then camping next to the construction site in a caravan – took legal action in June 2017 to obtain compensation. The September 2017 expert report mentions the risks of the building collapsing, but the battle promises to be tough for Thierry Moreau. It appears that GME Technique, insured with SA Gan Assurances, behaved like a general contractor. However, it was not insured as a prime contractor or builder of individual houses but only for very specific and limited trades. And the decennial could not take responsibility for the faults committed by GME because no report of acceptance of the work was established, and for good reason.

Last November, when the site had been abandoned for a long time, the La Rochelle court held GME Technique fully liable, with damages assessed at 232,613.76 euros. A sum that will probably never touch Thierry Moreau, the judicial liquidator having made it known that the situation of the company was definitely burdened.

Worse for the 50-year-old, the court ruled that he had to pay the legal costs of SA Gan Assurances, forced to defend itself, in the amount of 2,500 euros (1). He sought and found other victims of the Nantes master builder and offered to unite to attack him.

To date, Thierry Moreau says he has spent 150,000 euros in legal and bailiff fees. His house is demolished at his expense. Team leader at the public works company Somelec (Périgny), he has been on long-term illness since March 2021, the date of the diagnosis of cancer which he attributes to the stress of his situation. After being housed for four months with a neighbour, he lived in a caravan on his land for two years, before acquiring a 49 square meter mobile home three years ago for 20,000 euros. A solution he preferred to a monthly rental of 600 euros.

His loan for his extension and renovation project, for a monthly amount of 391.84 euros, runs until 2036. His life is summed up between his chemotherapy and maintaining his 2,000 square meters of land. These problems estranged his family. His neighbor and friend, Jacques, and Laurent Renaud, mayor of the town, provide him with support and assistance. The town hall grants him the installation of the mobile home as long as Thierry Moreau has no other solutions. What the city councilor regrets, “is that people have never been at the heart of the various meetings of experts, insurers and lawyers. The feelings of Mr. Moreau have never been taken into account. I sent letters and made phone calls to the parties concerned who all told me to take care of my business…” Thierry Moreau, for his part, has dark thoughts but declares: “I cling to life for those who support me. »
