Complaint dismissed – ban on begging in Salzburg remains in effect

The Supreme Court dismissed a complaint from the “Platform for Human Rights”.

For several years now, there have been a number of no-begging zones in the center of Salzburg – and this is likely to remain the case in the future. The “Platform for Human Rights” had turned to the Constitutional Court (VfGH) last year, wanting to overturn the ban. Now the Supreme Court has made a decision. The Constitutional Court declined to deal with the complaint. Because this “does not have a sufficient chance of success”, as the decision literally says. Specifically, the “Platform for Human Rights” referred to the case of a woman from Romania. She had begged in Schanzlgasse and received a fine of 100 euros. The complaint against this is now before the VfGH. In the past, the Supreme Court has repeatedly dealt with the ban on begging in the city of Salzburg. In the years 2012 and 2017, the corresponding ordinances of the municipal council were overturned. A modified and locally limited ban now applies.
