Consumer advice center condemns mobile phone providers: Termination of users was not accepted


Oliver Buttler, legal expert at the consumer advice center in Baden-Württemberg, says: “Primamobile GmbH simply tried to mislead the customer and give him the feeling that he had done something wrong, or that he was still there would have to do anything to make the termination valid – that’s clearly unacceptable.”

The district court of Berlin (Az. 97 O 99/21) followed this view. Primamobile was ordered to refrain from such business conduct in the future. It is clear from the judgment that termination of the mobile phone contract by e-mail is also effective.
