CPF, dropshipping, betting: more than half of influencers do not respect the law

The noose seems to be tightening on influencers with the crackdown on fraud springing into action.

Are we moving towards a moralization of the influencer sector? In any case, this is the will of the DGCCRF, a survey of which has just revealed that nearly 60% of them do not comply with the regulations. Actions will be taken to put an end to this situation.

6 out of 10 influencers break the rules

Bruno Le Maire had announced it: after numerous abuses and endless scandals, the world of influencers must be regulated. And to start the project, the government will be able to rely on a survey by the DGCCRF on influence marketing, the first findings of which have just been published.

The fraud crackdown has targeted around 60 influencers since 2021 for their “ promotion of products and services such as food supplements, “slimming” programs, cosmetics, or online trading or betting services “. Result, 60% of them would go against the regulations on advertising and consumer rights.

The majority of offenders did not respect the transparency of the commercial nature of their operations. Some of them are also accused of having deceived consumers about the quality of their products, promoted betting without respecting the rules, diverted money from the professional training account or pushed their audience towards dangerous aesthetic injections. The picture is dark.

Sanctions will be taken

The repression of fraud explains that it has initiated procedures to sanction offenders and call them to order. Beyond these warnings, the most serious cases detected will be the subject of a report intended for the public prosecutor. He can then take legal action.

The administration also recalls that influencers must respect obligations such as indicating whether it is a commercial advertisement or not. She explains that she will remain on the alert on the subject in order to protect the youngest in particular, and that she intends to intensify her checks in the months to come.

There should indeed be work for the DGCCRF. The scandals did not stop after the first speeches of the Minister of Economy, as shown by a new giant complaint which has just been launched against NFT influencers.
