CSA + Hadopi = Arcom, understand everything at the audiovisual and digital supergendarme


Arcom, here is the new acronym that will quickly memorize those who follow the news of the regulation of the media and the digital sector.

Because on January 1, this new organization – the Audiovisual and Digital Communication Regulatory Authority – replaces both the CSA, the audiovisual regulator, and Hadopi, the anti-piracy agency.

Arcom has nine members appointed by decree for a non-renewable six-year term. The president of the authority will be appointed by the President of the Republic.

Roch-Olivier Maistre, president of the CSA since 2019, becomes the president of Arcom.

“In 2021, the landscape has changed considerably with new very powerful players, including subscription streaming platforms, social networks,” he says, directly targeting GAFA. “This transformation has been accompanied by important phenomena such as the development of pirating, false information, the phenomenon of online hatred … It was therefore necessary that the regulator embraces its time and the world as it is today”.

Beyond the graduated response

In addition to the graduated response system against piracy, which consists of sending several warnings to an offending Internet user before the initiation of legal proceedings, Arcom will adopt “a new approach” to counter illegal streaming platforms.

In fact, Arcom “will draw up lists of illegal sites in conjunction with the beneficiaries”, who will be able “to take legal action to have (these sites) banned from Internet service providers”, says Roch-Olivier Maistre.

Arcom will specifically target the duplication of mirror sites, which include content from sites blocked by the courts. The new authority will be able to ask to block these mirror sites, and will be able to ask “any operator of search engine, directory or other referencing service to stop the referencing of the electronic addresses giving access to these communication services to the public online”.

In the area of ​​sports piracy, which has been expanding rapidly in recent years with IP TV systems, event organizers (large sports federations, audiovisual broadcasters) can for their part “take urgent legal action to block sites that broadcast sporting events illegally, ”he adds.

The challenge of regulating social networks

Arcom will also have subscription video platforms, social networks and online sites with at least 5 million unique visits per month within its regulatory scope.

Arcom will monitor the means put in place by online platforms to combat the manipulation of information or the dissemination of hateful content.

But also to protect the youngest, in particular by enforcing the ban on access by minors to pornographic sites, a new mission set by law this summer.

It should be noted that in order to note the facts “liable to constitute infringements of rights”, Arcom agents may “participate under a pseudonym in electronic exchanges liable to report on these infringements” and “extract, acquire or keep by this means evidence ”. The law specifies that these devices for investigative purposes will not have the effect of “inciting others to commit an offense”.

In addition to these new missions, Arcom will continue to regulate traditional media (radio, television).

To carry out all of these missions, Arcom will have 46.6 million euros, ie the addition of the resources of the CSA and Hadopi.
