David Ginola loses his appeal against “Complementary investigation”

Former French football international David Ginola had filed a lawsuit for “invasion of privacy” on the France 2 program “Complément d’Enquête”, following the broadcast of a portrait of his former teammate and current coach of the France team Didier Deschamps, during the 2018 World Cup.

He denounced an invasion of privacy and claimed 80,000 euros in damages. Former French football international David Ginola loses his appeal against Further investigation. The footballer had already lost his trial at first instance against the France 2 broadcast at the end of 2020. A verdict confirmed on May 25, as revealed this week by our colleagues from the newspaper Capital. The cause of the discord: the distribution of a portrait of Didier Deschamps in 2018.

No invasion of privacy for the Court of Appeal

In this investigation, the journalist from Further investigation had broadcast recorded remarks without the knowledge of David Ginola. The ex-footballer confided his bitterness vis-à-vis Didier Deschamps: “If I didn’t make the 1998 World Cup, it’s because of him”, he said without knowing that he was registered. “He is someone who for me prevented me from realizing my dream. […] Please don’t ask me to talk about an event that brought my whole family to tears.”

The court considered that this information was already known before the publication of Further investigation and therefore did not constitute an invasion of privacy. David Ginola had already confided in the press on this subject. David Ginola does not intend to appeal to the Cassation. He is “disgusted” and does not wish to “elaborate further”, in the words of his lawyer to Capital.
