Donald Trump took Twitter to court after his account was suspended. But now a judge has dismissed the lawsuit.

Former US President Donald Trump (75) has to take a defeat in court. The 75-year-old had filed a lawsuit against the short message service Twitter. But a federal judge in San Francisco dismissed it on Friday (May 6), as reported by CNN, among others. Trump wanted the lawsuit to have his suspended Twitter account reactivated.

Twitter has not violated the right to free speech

Judge James Donato dismissed the lawsuit because Twitter’s closure of his account did not, as the ex-president claims, violate his right to free speech. This is protected by the First Amendment of the US Constitution. However, the First Amendment applies to government interference and does not apply to alleged interference by private companies, the statement said.

The judge emphasized that “no claim under the First Amendment to the Constitution was asserted against Twitter”. The lawsuit is therefore dismissed. But Donato decided that Trump could re-file an amended lawsuit. The short message service has not yet commented.

Donald Trump was banned in 2021

Donald Trump was banned from Facebook and Twitter in early 2021 after he was said to have contributed to the violent storming of the Capitol in Washington on January 6, 2021 with apparently inciting messages. In the meantime, Trump has set up his own social network with the “Truth Social” platform.

It was only in April that Tesla boss Elon Musk (50) bought Twitter for 44 billion US dollars (equivalent to 41 billion euros).
