Ethereum: transactions soon to be censored because of OFAC?

MEV-Boost: a marketplace for Ethereum blocks

the Mev Boost is an open source software that the company Flashbots has designed to allow validators who use it to access a block building marketplace. This platform contains blocks offered by manufacturers who are also responsible for ordering the transactions within these blocks, to optimize the maximum extractable value (MEV).

The maximum extractable value corresponds to the maximum income that the production of a block can generate, by excluding certain transactions or by modifying their order. This income that the producer of the block receives is in addition to the classic block reward and the gas fee.

With Mev-Boost, validators can thus buy this optimized deal flow in each block, which the builders put up for sale. By offering the block, validators can subsequently collect the maximum extractable value relating to it.

On its website, Flashbots claims that separating the roles of proposers and builders would favor “greater competition, decentralization and censorship resistance for Ethereum”. This statement is actually a simple marketing pitch which contrasts with reality.

OFAC: the biggest validator on Ethereum PoS?

According to data from MEV Watch, 64% blocks built via the Mev-Boost relay conform to the requirements ofOFAC from The Merge.

OFAC (or the Office of Foreign Assets Control) is the American intelligence agency which is responsible in particular for the implementation of the legal provisions taken by the Treasury Department.

The organization attacked the Tornado Cash protocol last August, accusing it of allowing the laundering over $7 billion. As a result of these accusations, Flashbots’ Mev-Boost would simply censored transactions related to Tornado Cash.

In view of the statistics from MEV Watch, over 60% blocks on Ethereum could therefore censor transactions on the network today, in accordance with OFAC guidelines.

Vitalik Buterin maybe want make Ethereum an anti-censorship world. But, while waiting for the implementation of really effective solutions to solve this problem, the extractable maximum value and the Mev-Boost puts the integrity of the network seriously in danger.
