Eurofins: ELMO raises the tone against Lactalis








(Boursier.com) — After the mention by certain media, on November 20, of the procedures targeting the Lactalis group since 2017 and on a procedure in the commercial court against Eurofins Western Microbiology Laboratory (ELMO), initiated by Lactalis, ELMO is carrying out a clarification in order to avoid “any misunderstanding, and to reassure its customers and partners”.

ELMO intends to demonstrate “the deficiencies of Lactalis and its responsibility in this crisis for which ELMO is in no way responsible and the unfounded nature of Lactalis’ requests”.

“Ignoring the results of ELMO analyses, having notably revealed on several occasions since 2009 and again in August 2017, the presence in the Craon factory of the pathogen having contaminated the babies, Lactalis does not seem to have implemented appropriate the control and withdrawal procedures provided for in such cases. An appropriate reaction would have made it possible to avoid the crisis of 2017. Faced with its own deficiencies, and to avoid facing its liability, Lactalis is formulating a request for compensation unfounded and does not provide any serious information as to the damage suffered”, considers ELMO.

“By putting forward an aberrant amount of such importance, Lactalis seeks to give credibility to its requests. Lactalis’ approach is all the more unfounded as the Lactalis Group has continued from 2017 to today to entrust analyzes to ELMO, testifying to its confidence in the work carried out”, indicates ELMO.

Eurofins Laboratoire de Microbiologie de l’Ouest continues: “In addition to the fact that Lactalis bears, due to its deficiencies, all the responsibility for a crisis for which ELMO is in no way responsible, Lactalis formulates a request whose exorbitant amount aims to avoid any debate on its own shortcomings. This request is not supported by any serious data and is limited to a global figure without any precise information being communicated. Such opacity is not admissible and the designated experts are waiting always the communication of essential information. As part of the expertise, the Paris Court of Appeal – in a ruling dated November 2 – also drew the consequences of such opacity by rejecting Lactalis’ request aiming to integrate its subsidiaries. LACTALIS also refused to specify the compensation from which it has already benefited, reflecting the purely media and communication aim of its request.
