The Harris Interactive research institute had also revealed that for 60% of French women, the perfume sample represents the first vector of discovery of a fragrance allowing it to play a primordial role in the purchasing journey. However, since April 23, perfumeries, cosmetics stores and even shopping centers are no longer authorized to offer free samples of perfumes or creams to their customers.

An implementing decree within the framework of the Environmental Code

If the Environmental Code indicated this ban since August 2021 as part of its text “Fight for reuse and against waste“, its contours not yet being well defined, professionals in the sector continued to provide samples to their clients. A text in which it is also indicated that plastic cotton swabs, plastic straws, or even the systematic printing of receipts or bank cards were also prohibited except at the request of the consumer.

A ban which was to take effect from July 1, 2022, but which in fact was still not applied in the absence of a decree describing the contours and modalities. It’s done ! On April 23, an official decree was published describing what the sample is: “a small quantity of merchandise given free of charge to consumers» whose packaging remains «different from the marketed product.» Without an explicit request from the consumer, it is now prohibited to provide them with a sample. Unpackaged foodstuffs or samples included in press publications are not affected by this implementing decree.

How to get around this ban?

But then, how do you try the perfume that you saw in advertising today or the one that everyone is talking about in the press? If the distribution of cream or perfume samples is prohibited, penalizing the market in the short term since customers are no longer able to test the products before purchasing, there is a solution to get around the problem. Indeed, at the consumer’s request, the professional can provide him with samples. It is therefore sufficient to inform the consumer of the situation by any available means, indicating that the sample can be given to them upon request.
