As you may know, since June 1, 2022, certain real estate loans are no longer subject to the health questionnaire. This is the consequence of the law of February 28, 2022 for fairer, simpler and more transparent access to the borrower insurance market, also called the Lemoine Law. Clearly, this law marks the end of the medical questionnaire, in certain cases. To answer your question, it actually depends on your age and the amount you want to borrow.

First, to avoid completing a health questionnaire, the borrower must have repaid their entire loan before their sixtieth birthday. Above all, the health questionnaire remains mandatory if the insured share of the cumulative outstanding credit contracts exceeds 200,000 euros per insured.

Clearly, if you borrow more than 200,000 euros, the bank has the right to ask you for a health questionnaire. Below, you have the right to refuse it, as the bank cannot legally impose it on you.

Real estate loan: will you benefit or be a victim of the end of the health questionnaire?

This limit of 200,000 euros per borrower means that a couple could theoretically borrow 400,000 euros without completing a health questionnaire. But it can nevertheless be circumvented by the bank. This is particularly the case when first-time buyers purchase a primary residence.

Because the banking establishment can request each of the co-borrowers to be 100% insured. In this case, we often speak of 200% coverage. This means that in this case each borrower is insured on the entire loan. In the case of a couple who borrow the sum of 210,000 euros for example, a health questionnaire will then be requested, because the bank estimates that each of the borrowers takes out a loan of 210,000 euros.
