if my child’s class closes, can I request a work stoppage?

Since Monday, March 29, the health protocol in schools has been tightened in the 19 departments under confinement. From now on, a single case of Covid-19 will be enough to close a class. A measure that forces parents to reorganize.

A scenario that repeats itself. A single case of covid-19 will cause the class to be closed for two to three weeks. So far, the class was closed from three cases of Covid-19 contamination. A measure that goes “necessarily mean more class closures in the coming days for those who are concerned”, said the Minister of National Education, Jean-Michel Blanquer.

To allow parents to organize themselves, the CPAM (Health insurance fund) will issue a derogatory work stoppage for parents who cannot telework, they will also benefit from partial activity. To do this, “Employees must provide their employer with proof of the closure of the establishment or a document from the health insurance certifying that their child is considered to be a risky contact case and is subject to an isolation measure at this title”, underlines Health Insurance.

For those who cannot use telework and whose children are under 16 years of age or have a disability, they can benefit from a work stoppage for compensated childcare. They will simply have to provide proof of the closure of the school.

However, “the civil servants working more than 28 hours do not benefit from the payment of daily allowances”, indicates Health Insurance. They must provide proof of the closed establishment which “allows the employer to maintain or place the agent on special leave of absence (ASA), when telework is impossible”.

What compensation according to my status?

  • To benefit from daily allowances, the employee must provide a sworn certificate to his employer justifying that he is the only one of the two parents to benefit from a work stoppage. He will then be compensated “Up to 84% of his net salary (100% if he receives less than 1.4 Smic). The employer will bear a remaining charge of 15% ”, precise BFMTV.
  • For civil servants, they will be paid up to 100%.
