In Poland, the specter of “Polexit” animates the public debate

It was a predictable result: Thursday, September 30, the Polish Constitutional Court postponed, for the fourth time in a row, the deliberation which should decide whether, yes or not, European law prevails over Polish law, as stipulated in the treaties of European Union (EU).

Prime Minister Mateusz Morawiecki lodged this request in March, after the Court of Justice of the European Union (CJEU) once again issued a scathing judgment pointing to non-respect for state principles of right by the conservative national government of PiS (Law and Justice).

In front of the seat of the Tribunal, in the grayness and the rain, a hundred demonstrators were gathered to shout their anger, waving flags with twelve stars and signs: ” We are Europeans ” ; “No to Poland’s drift to the East”, with portraits putting on the same plane the strong man of the country, Jaroslaw Kaczynski, the Belarusian dictator Alexander Lukashenko and the Russian president, Vladimir Poutin.

The highest legal body in the country, yet under the orders of the majority, does not have an easy task: if it asserts the primacy of Polish law over European law, the consequence would be a veritable “legislative polexit”, a scarecrow brandished for a long time. date by the Democratic opposition. If she says otherwise, it would be a setback for the government.

The next day, Friday, Donald Tusk, former Prime Minister and President of the European Council, returned to the head of the largest opposition party, the Civic Platform (PO, center right), put on the table a proposal for reform of the Constitution. It stipulates that the government can withdraw from an international agreement by a two-thirds majority of Parliament, not by a simple majority, as it is now. The stated objective: to prevent, in the more or less long term, a potential exit from the EU.

Less than 10% in favor of “Polexit”

Mr. Tusk had announced this initiative two weeks earlier, during a convention of his party. “The EU, in all its aspects, bothers the PiS and Kaczynski, he had hammered. They are working hard to disgust the Poles in the EU and to confuse their minds. I know that in the end they want to get Poland out of the EU. “

The former Prime Minister, who gave himself the mission of saving the party he founded from the rout, intends to create a divide around “Polexit” and adherence to the values of the EU the main axis of the political debate in view of the legislative elections of 2023.
