INFO Europe 1 – A radicalized Algerian, on “S” file and under OQTF, released by the courts

According to information collected by Europe 1, the Versailles Court of Appeal decided to release from the administrative detention center (CRA) an Algerian, on “S” file and under an obligation to leave French territory (OQTF) . He was placed under house arrest.

The day after the Arras attack, Gérald Darmanin announced “the systematic expulsion of any foreigner considered dangerous by the intelligence services”. This was without taking into account possible legal obstacles.

Under OQTF, released but under house arrest

According to information from Europe 1, a 40-year-old Algerian was released by French justice from the administrative detention center where he was held. He was released last night by the courts and taken home by the police. He is now under house arrest, even though he has been under an obligation to leave French territory (OQTF) since May 2021, issued by the police headquarters. Our JDD colleagues also indicated that this individual was sentenced to nine years in prison in 2017 after leaving for Syria to join the Islamic State in 2013.

On October 20, this man, classified as “S” and registered in the file of reports for the prevention of radicalization of a terrorist nature (FSPRT), was arrested and admitted to the administrative detention center (CRA) in Plaisir (Yvelines). On two occasions his detention was extended. But on the third request for an extension, a judge of freedoms and detention in Versailles issued an order refusing to authorize the continuation of the detention.

The Versailles public prosecutor’s office and the Yvelines prefecture then appealed. And the case ended up, according to a judicial source, before the advisor delegated by the first president of the court of appeal. Which declared yesterday evening the release of this radicalized foreigner in an irregular situation, accompanied by house arrest.

Yesterday, 19 foreign offenders were expelled from the territory, the Minister of the Interior announced on Twitter.
