“It’s free and simple”… The government wants to strengthen Visale, the deposit that appeals to tenants and owners

A tenant who does not pay his rent is a landlord’s nightmare. But there is a free deposit: the Visale guarantee provided by Action Logement. A device that the government wants to boost so that it benefits more than 2 million people in 2027. Explanations.

Rental investment is not always a long calm river: sometimes a small grain of sand, which can be summed up in three words, can derail the success of your projects: unpaid rent. The percentage of unpaid rents is approximately 1.5% each year for the entire rental stock. Thanks to Visale, you can be protected for free.

The advantages of the Visale guarantee

The guarantor is a natural or legal person who acts as guarantor and undertakes to pay if the debtor defaults. In terms of residential leases, this may be a family guarantee or provided by an organization, in particular Action Logement (ex 1% housing) which offers the Visale system.

Action Logement is financed by a tax paid each year by certain companies, so it is a real public guarantee for rental housing, free for tenants and owners alike.

Historically created to guarantee people in a precarious work situation, the Visale guarantee has seen the scope of its beneficiaries widen. It facilitated the signing of more than 280,000 new rental contracts in 2022, a figure that continues to grow. On Monday, the government unveiled the measures of its plan to deal with the housing crisis. And he announced in particular that the Visale guarantee will be extended to “more than 2 million people” by 2027, against 1 million since 2018.

Conditions to be fulfilled

In concrete terms, the Visale guarantee is aimed in particular at young people aged 18 to 30, whatever their situation, employee, student, civil servant, job seeker, work-study worker or apprentice, which is logical since work-study and apprentices are employees.

The Visale guarantee has also been extended to certain private sector and agricultural sector employees hired for less than six months, and all those earning less than 1,500 euros net per month. The same is true for tenants who have signed a mobility lease, and employees who have signed a promise of employment for less than three months. Visale also covers tenants who move into rental intermediation accommodation, whose lease is taken out by a solidarity association.

Condition to be met by all those who wish to benefit from Visale’s guarantee: the rent including charges is a maximum of 1,300 euros per month (1,500 euros in Ile-de-France) and does not exceed half of the tenant’s resources.

To expand the number of beneficiaries at Visale, new criteria must be set by Action Logement in the coming weeks.

up to 36 monthly payments reimbursed

In the event of non-payment, the Visale guarantee will pay the owner of the premises a maximum of 36 monthly installments including rent and charges, or in the case of a nine-month student lease, nine monthly installments. This rental guarantee must be requested by the tenant before signing the lease on the website www.visale.fr

This is not a gift: the tenant will reimburse the surety body for the sums that have been paid to the lessor in his place for unpaid rent.

A guarantee that does not always apply

The Visale guarantee only applies if the accommodation is decent, ruled the Court of Cassation in a judgment delivered on May 6, 2021 (3rd civil chamber, n° 20-15.094). In this case, a tenant refuses to pay his rents and charges, arguing that the accommodation is indecent.

The lessor then turns to the bond system to claim payment of the unpaid bills, and is refused due to the indecency of the premises. He launched a legal procedure but lost it: the judges of cassation confirmed that indecent housing could not benefit from this guarantee system.
