As a reminder, his legal action concerned the fact that he may have had recourse to the Dutreil pact in order not to pay wealth tax. Indeed, before the ISF was abolished by Emmanuel Macron in 2017, Jean-Pierre Foucault should have paid it. He should even have paid 68,817 euros in wealth tax. “Which with the rate in force at the time, corresponded to a heritage of approximately 7.5 million euros“, indicate our colleagues from Capital. Only, in order not to pay this sum, the host had recourse to the Girardin law which makes it possible to exempt investments in Dom Tom from tax. He also took advantage of the Dutreil pact to reduce his wealth tax by 75%..
But a problem arises since to be able to claim this tax reduction, the activity of the declared company must be mainly commercial. However, he has invested in renewable energies with his company Parasol Production (he has invested in photovoltaic panels in Guadeloupe and in companies in Santo Domingo). But this company did not meet, in 2017, for the tax authorities, all the conditions to benefit from the Dutreil pact.
