A man from Swabia faces a sentence of at least one year in prison for posting a 15-year-old nude photo of his penis manipulating young son on Whatsapp as a status photo.
The now grown-up son had sent the picture to his 59-year-old father as a funny childhood memory and also consented to the publication by the father, the Swabian police headquarters announced on Friday in Augsburg.
The police are now investigating the allegation of possession or procuring and the distribution of child pornography against the father, as he had made the picture public. The investigators pointed out that in the event of a conviction there is a risk of at least one year and a maximum of ten years imprisonment.
The father’s apartment is raided
The police came across the father through a witness who had discovered the status picture during a chat. On it, the then about six-year-old son could be seen with a bared lower body. Sitting on a sofa, he played with his penis with his legs apart, while a grown man wearing only underpants put his arm around the boy’s shoulder.
During a raid on the father’s apartment in the Augsburg district and a review of his electronic media, the police did not find any further criminally relevant images. The man was never noticed in connection with child pornography. It was also possible to clarify that no sexual abuse or the like took place during the admission.
After the son saw a funny childhood memory in the photo that was accidentally rediscovered, the father found the publication – after asking – even funnier, the police said. This has now warned imitators with reference to the law to combat sexual violence against children, which has been in force since July and which has tightened the penalties for child pornography.
