His friend essentially died in his arms after a horror accident in Saxen – it was so traumatic that an Upper Austrian man successfully sued the person who caused the accident for compensation for pain and suffering and loss of earnings, totaling around 6,600 euros. He was proven right across all instances up to the Supreme Court.
It was a terrible accident: eight friends from the Innviertel were traveling on their mopeds in the Perg district in June 2021. In Saxen, a pensioner (64, from Waldhausen) drove his car into the group without braking. Two moped drivers (29 and 48 years old) were killed. The pensioner received seven months conditionally in November 2021. It is not known whether the verdict became final.The legal aftermathA friend of one of the victims was 45 to 50 meters away, wanted to provide first aid and suffered an acute stress reaction, followed by post-traumatic stress disorder. He demanded 4,000 euros in compensation and 2,600 euros for loss of earnings. The case went through all the instances, and now the Supreme Court also ruled in favor of this plaintiff.
