OGH judgment – University of Applied Sciences Upper Austria has to pay 2.5 million

Assistant professors at the Upper Austrian University of Applied Sciences had to go to the Supreme Court twice to get their rights and, above all, the back pay they were entitled to. The Chamber of Labor supported her in this. Now the university of applied sciences has to pay 2.5 million euros.

University employees had been paid too little for many years. The OGH already determined this in 2020. Nevertheless, the Upper Austrian University of Applied Sciences did not pay the additional claims, so that the AK had to file a lawsuit again. And the Supreme Court ruled again in favor of the workers. He promised them additional payments totaling 2.5 million euros. The Upper Austrian University of Applied Sciences has to pay one million euros in procedural costs. It is to be feared that the high procedural costs that have arisen as a result will have to be financed by taxpayers.”
