Bodily harm resulting in deathThe 32-year-old was sentenced to four years in prison in November for bodily harm resulting in death, but appealed. “My client showed remorse at the hearing in November and is already facing the ruins of his existence,” argued his defense attorney at the appeal hearing. Thus, the man – who was under the influence of considerable alcohol at the time – was “sufficiently punished” even with a partially suspended prison sentence or with the minimum sentence of two years. “Mitigating circumstances already taken into account”The Higher Regional Court saw it differently. The mitigating circumstances had already been sufficiently taken into account at the main hearing. With a sentence of up to 15 years, there is no room for maneuver, especially since the sentence at the time was already “set at the lowest range.”
