And one more complaint for OpenAI! A group of American authors has just filed a lawsuit against the company for the use of their texts in the training of ChatGPT without their consent.

Language models are trained on vast amounts of text from the Internet. The question of copyright was bound to come into play at one point or another.

An infringement of copyright, according to the plaintiffs

David Henry Hwang, Rachel Louise Snyder, Ayelet Waldman and Michael Chabon, who has already won the prestigious Pulitzer Prize, accuse OpenAI of profiting from “ unauthorized and illegal use » of their copyrighted content.

According to them, ChatGPT’s ability to summarize and analyze their works is evidence of their use in training its language model. They consider that the texts generated by AI regarding their content constitute a work “ derivative » of their productions. Filed in San Francisco, the complaint also states that works such as books, plays and articles are particularly valuable to ChatGPT’s training because they are “ best examples of high-quality, long-form writing “.

OpenAI’s actions in copyright infringement were intentional, willful, and in callous disregard for the rights of Plaintiffs and Class Members. OpenAI knew at all times that the datasets it used to train its GPT models contained copyrighted material and that its actions constituted a violation of the terms of use of such material. », denounces the complaint document.

A legal vagueness

This is not the first case targeting OpenAI for similar facts. Two writers as well as the famous actress Sarah Silverman also filed a lawsuit against the company for the unauthorized exploitation of their works.

This phenomenon also affects AIs that generate works of art, causing waves of indignation within the artistic community. If legislators, particularly European ones, are working to regulate the technology, it is currently encompassed by vague legal contours.

In this new case, the authors are seeking an unspecified amount of damages as well as a decree blocking the “ illegal and unfair business practices » from OpenAI.
