Pension reform: the decrees will be published before September 1


The 31 texts of application of the pension reform will be published before September 1, the date of entry into force of the reform, said Wednesday the cabinet of the Minister of Labor Olivier Dussopt. “There is no delay, we will be there,” said Olivier Dussopt’s cabinet in a telephone briefing. “There is a form of priority” to first publish the texts “which condition the age of departure”, and those “which give new rights” such as the increase to 85% of the Smic (1,200 euros gross) of the minimum pension for all those who have contributed a full career (43 years), the same source said.

The unions keep watch

The government and the administration are under pressure to put to music a reform rejected by the unions and a large part of the opinion. The unions are watching the grain and will not fail to rush into the slightest legal breach when the decrees are published. For the moment, two draft decrees have already been drafted by the departments of the ministry, and are currently subject to consultation, in particular with the National Old Age Insurance Fund, according to the cabinet of Olivier Dussopt.

One of these two decrees, which concerns the application of the reform to civil servants, was submitted for an opinion to the Council of State. Other decrees, the number of which is not yet known, will follow this path to obtain maximum legal security.

The revaluation of the minimum pension effective from 1 September

On the delicate subject of the revaluation of the minimum pension, this will be effective from September 1 for all people retiring from this date, said Olivier Dussopt’s cabinet.

For all people who are already retired, but who should benefit from it (1.8 million people), “the majority” will receive an increased pension as soon as their pension for the month of September is paid, at the beginning of October, according to the Ministry. For the others, their pensions will be revalued “in the months that follow, with retroactivity” to September 1. In general, “no person” currently retired will have to return to work when the detailed rules of the game for the reform have been fixed, assured the office of the Minister of Labor.
