You can launch a power of attorney online if you cannot go to the polls on the day of the 2022 presidential election. A suitable site exists. Unfortunately, the process is not 100% dematerialized.
The French presidential election of 2022 is now imminent. The first round will take place on April 10, followed a week later by a second round if no one immediately obtains 50% of the votes cast. There are now twelve candidates in battle order for the ballotwhose final list was announced by the Constitutional Council.
How to have a power of attorney for the presidential election of 2022?
If you are not yet on the electoral lists, know that it is too late for this election: you had to register until March 2 (online) or March 4 (in town hall). Conversely, if you are registered or registered (it is possible to check your electoral situation online), but you risk having a constraint to go to a polling station, there is the power of attorney.
The good news is that this process can be done online, at least for the most part. Since the spring of 2021, the administration has operated a dedicated website, entitled maprocuration.gouv.fr. Anyone can use it and file a power of attorney request. You will then have to identify yourself using the famous France Connect platform.
FranceConnect designates the access portal for public services, which relies on a centralized connection system. Thanks to it, with a single username and password, it is possible to connect to hundreds of procedures. This can be to access the tax site, health insurance or in anticipation of renewing identity papers.
Be careful though: the process is certainly practical, but is not entirely dematerialized. It is always required to go to a police station or a gendarmerie brigade to validate your identity. The power of attorney must be validated within two months from the date on which it was made on the site.
This constraint aims to avoid the risk of fraud, by carrying out an identity check, but also to ensure that the power of attorney has been freely decided, without external pressure. Attention again: for the power of attorney, you must know the national voter number of your proxy (the person to whom you are giving power of attorney). This number is written on the electoral cards.
What data is used for the online proxy?
The arrival of this new service was expected: the government published in the Official Journal a decree modifying the provisions of the electoral code relating to proxy voting and establishing a teleprocedure, on March 12, 2021, then an order relating to the teleprocedure for the establishment of voting proxies, March 31, 2021. Both texts have since entered into force.
The procedure being partly electronic, and it involves de facto personal data, computer processing is obviously planned. In particular, the principal’s information (including surname, first name, sex, date of birth, municipality of registration on the electoral lists, email) and that of the agent (surname, first name, sex, date of birth) are recorded.
Other information, which does not directly concern voters, is retained: the authority that validated the proxy, the type of ballot, the round, the date of the election and the expiry date of the proxy. The data is kept for one year from the date of expiry of the power of attorney. If the power of attorney is not made, the deletion takes place two months after the date of the request.
Online power of attorney: an old objective
This idea goes back a long way. It already appeared in 2017 in Emmanuel Macron’s program for digital. ” By 2022, 100% of administrative procedures can be carried out from the Internet – except for the first issue of official identity documents. For example, it will be possible for the citizen to apply for an electoral proxy without going to the police station. “.
According to the Maire-Info site, the device mobilizes three accesses, which are interconnected: that for voters, that for the police and that for town halls. This is required on the one hand so that the principal’s data is transmitted to the police, for the purpose of identity verification, and on the other hand so that the power of attorney request reaches the municipalities, which will have to administratively everything is in order.
This device was also called upon to be simplified. It was a question, according to our colleagues, of an interconnection with the single electoral register which will be used to automate the task which is temporarily entrusted to the town halls (verification of registration on the electoral rolls of the municipality and control of the ceiling of the number of proxies per person). The goal: to relieve the town halls.
Given the need for consultation to verify the identity of individuals, the decree authorizes access to personal information entered on the online proxy site. This concerns judicial police officers and agents, municipal agents and agents of the digital department of the Ministry of the Interior. At least, those who have received clearance.
Finally, to prevent any abuse, the operations of consultation, creation, modification or deletion of personal data carried out by all authorized persons are recorded for a period of one year. The purpose of the operation, the identifier of the author, as well as the date and time must be entered to track a request for deletion made by an individual, on behalf of the GDPR.
