The legal situation briefly explained:
Tenants are generally allowed to do whatever they want in their apartment and on their balcony: hanging up laundry, planting tomatoes, smoking, barbecuing or feeding the birds.
However, they must not disturb their neighbors excessively and must observe rest times. Of course, it’s not possible to completely smoke your neighbors, for example. However, neighbors have to tolerate the occasional smell of grilled meat or a cigarette.
Feeding birds on the balcony is also permitted as long as the birds do not excessively dirty a property. Most songbirds do not cause any problems in this regard. It’s different when tenants feed pigeons. Their feces can release dangerous pathogens into the air you breathe, and the building facade can also be literally burned.
A court in Berlin ruled: Feeding birds on balconies is allowed – with the exception of pigeons. This decision can also be used as a guideline for Switzerland.
For the “Espresso” listener this means: her neighbor cannot forbid her from putting up a birdhouse. His intervention with the administration is likely to be unsuccessful due to the clear legal situation. In addition, the relevant house rules do not prohibit setting up birdhouses on the balcony.
