Received asylum in 2016 – Before double murder: seven charges against suspects


Two women are dead, a 28-year-old man from Somalia and the ex-partner of one of the two victims are highly suspicious. The suspect was already known to the police, but was previously considered to be innocent because he was never convicted. More and more details are now becoming known about the case of the 28-year-old suspect who killed two women, including the mother of his four-year-old daughter, in the Favoriten district of Vienna on Monday afternoon.

An interrogation of the man is still pending – this is apparently also due to the heavy alcoholism of the 28-year-old, which he had shown on Monday afternoon. The man had 2.2 per mille of alcohol in his blood. On Tuesday, however, the suspect will be asked what happened in the apartment on Belgrade Square. In addition to the mother of his four-year-old daughter, a Caritas interpreter who was apparently friends with the woman also died.

The Somali came to Austria in June 2014 and applied for international protection. After a default complaint to the administrative authority in 2015, the Federal Administrative Court recognized him as being entitled to asylum in July 2016.

Proceedings terminated, no conviction
Several times, however, criminal charges were filed against the 28-year-old (see list below). Among other things, it was about rape, sexual abuse in connection with property damage and bodily harm. The alleged acts were apparently all committed in Linz, the place where the Somali lived.

No proceedings, withdrawal proceedings stopped
The Federal Office for Immigration and Asylum would have quickly initiated proceedings to withdraw the Somali’s asylum status after taking note of the reports. But since the proceedings were closed, the withdrawal proceedings were also stopped.

“If crimes are known and reported, for example sexual offenses, the BFA quickly initiates a withdrawal procedure. It is important to add that these withdrawal decisions are always tied to the court decisions or those of the responsible public prosecutor’s office, ”said the spokesman for the Ministry of the Interior, Patrick Maierhofer. If there are no facts that justify the withdrawal, the procedure is also invalid.

According to information from krone.at, there were a total of seven charges against the Somali – none of them resulted in a conviction. The Federal Office for Immigration and Asylum could nevertheless – as in the Leonie case at the time – at least legally, initiate a withdrawal procedure independently.

“Eight out of ten ads without a judgment”
In any case, the Association of Autonomous Austrian Women’s Shelters expressed criticism of the termination of the proceedings on Tuesday afternoon. “Eight out of ten reports of domestic or sexual violence are currently without a verdict. Particularly in the case of very dangerous offenders, the rate of posting of advertisements urgently needs to be reduced and the conviction rate increased. If measures are inadequately applied, that is a license for the perpetrators! ”, It was emphasized.
