This Sudanese was recently sentenced to three years’ imprisonment and a five-year ban from French territory for “assistance with the illegal entry, movement or stay of foreigners in an organized gang“, underlined the CNDA, administrative jurisdiction which rules on the appeals lodged by people whose right to asylum has been rejected at the Ofpra (French Office for the Protection of Refugees and Stateless Persons).

“Threat to society”

By a decision of June 1, 2022, the National Court for the Right of Asylum confirmed the withdrawal of refugee status from a Sudanese national involved in a network of smugglers whose presence in France constitutes a serious and current threat to society.the court wrote in a statement. His decision makes this withdrawal final.

The Court took note of the criminal decision pronounced against the applicant, according to which he joined a network of smugglers from the year of his arrival in France, in 2016, and led many people to this illegal organization from Africa until his arrest in October 2017“, further specified the CNDA. Asked by AFP, the Court did not indicate whether this was the first withdrawal of refugee status on this ground.

During his first term, President Emmanuel Macron had been strongly criticized, on his right, because of the low rate of execution of “obligations to leave French territory(OQTF). During the presidential campaign, he promised that “the refusal of asylum will be worth obligation to leave the French territory», a proposal that clashes with the current state of the law.
