Judicial information has just been opened, entrusted to the investigating judge Camille Guillermet, for “willful violence by a person holding public authority resulting in death without the intention of giving it, voluntary violence by a person holding public authority. ‘public authority with the use or threat of a weapon resulting in total incapacity for work for more than eight days and willful violence by a person holding public authority which did not result in total incapacity for work’, as well as the public prosecutor, Laure Beccuau, announced it yesterday. It targets the three police officers who fired the shots, some of them fatal. Placed in police custody for 48 hours, they were released yesterday without any charge.

On Tuesday, the driver was taken into custody, which was extended today. He was heard by the judicial police in charge of the investigation, which was opened for “attempted homicide of a person holding public authority, refusal to comply aggravated by the endangerment of others, conduct despite cancellation of driving license and driving under the influence of an alcoholic state and after having used substances classified as narcotics”. According to our information, Mohamed M. said he did not hear his passengers ask him to stop. He nevertheless expressed “deep” regrets for not having obeyed police orders. He admitted that he was driving without a license and in a state of alcohol.

Contacted by Pointone of the driver’s two lawyers, Mr.e Ibrahim Shalabi reacted to the complaint that Sylvie Noachovitch, lawyer for Rayana’s family, intends to file: “My client did not cause Rayana’s death. Rather, it was the rage of the police and their gunfire that killed her, making it look like they were in a war zone as the vehicle was stuck in traffic. If he is known to the police, it is mainly for minor offences. At 38, he was serving a one-year sentence on day parole. We are far from the portrait of the perfect culprit that we wanted to make of him. He is no exception to the rule of victims of police violence who are tried to discredit from the start of the investigation.
