A new text repealing retirement at 64, which the Insoumis deputies planned to include in their “parliamentary niche” at the end of November, was deemed inadmissible on Wednesday by the highest authority of the National Assembly, a “democratic shame ” according to LFI. The decision was ratified by a vote of the Assembly office. It was notably justified by the constitutional prohibition for parliamentarians to create charges for public finances, and by the need to protect the institution from “contradictory” decisions, parliamentary sources told AFP.

“It is just the negation of Parliament, that is to say that Parliament could not change a law which I remind you has never been voted by the National Assembly” because “passed by force, by 49.3″, reacted Mathilde Panot, the leader of the LFI deputies, in front of journalists. “The most serious thing is that Yaël Braun-Pivet (the president of the Assembly, editor’s note) explained that this decision would apply to all the texts which would like to repeal retirement at 64, it is a democratic shame, a scandal”, judged Mathilde Panot.
The office of the Assembly – which notably includes the vice-presidents, quaestors and secretaries of the institution – had already rejected two BIA texts in mid-October aimed at repealing the reform. But the Insoumis thought they had found the solution by proposing this time the examination of one of the two repeal texts tabled earlier in the year by the independent Liot group, which had passed a first admissibility filter without being subsequently examined .

The two deputies responsible on behalf of the office for passing the proposed laws through the filter of Article 40 of the Constitution, on financial admissibility, had in fact given their green light. But one of them, a member of the presidential camp, “reversed his decision, which gave the office the possibility of a re-examination”, one of its members told AFP. “The regulations do not authorize this,” said LFI president of the Finance Committee, Éric Coquerel, on Tuesday. “It is extremely serious in terms of jurisprudence,” he added, saying he was studying the possibility of appeal.
LFI had planned to include this repeal text at the top of the agenda for its day reserved for the Assembly, November 30. The Liot group took the same initiative during its “parliamentary niche” in June. But the repeal text that they had put forward had been emptied of its substance in committee, before Yaël Braun-Pivet blocked, in the name of article 40 of the Constitution, amendments restoring his measure- beacon before the debate in the hemicycle.
