Sexual assault of Shaïna in Creil: reprieve for the main accused


The main defendant in the trial for sexual assault in 2017 in Creil against Shaïna, 13, murdered two years later, was sentenced on Tuesday to a one-year suspended prison sentence and another defendant was released.

The young man, then Shaïna’s boyfriend, was 14 years old at the time of the events, in August 2017. He was sentenced to 12 months with probation for two years. Designating him as “the leader” of a trio of attackers, the prosecution had requested two years in prison against him, one of which was suspended on probation.

Two other defendants, then aged 16 and 17, were sentenced to eight months in prison, suspended probation for two years.

Guilty of sexual assault and violence in meetings

All three were found guilty of sexual assault and violence in meetings but released for the dissemination of pornographic images of a minor.

A fourth boy, also a minor at the time and tried for another sexual assault, a week before that of this trio, was released. The public prosecutor has indicated that he is considering an appeal in his case.

“Shaïna was recognized as a victim”

Before the criminal court for children, where the trial was held behind closed doors, the defendants’ lawyers pleaded for release, citing an empty file.

“Thanks to her constant declarations, Shaïna was recognized as a victim. She’s not a liar, “said Negar Haeri, lawyer for Shaïna’s family, on Tuesday, saying to herself, however, “very sad that she is not there to realize it, it’s unbearable”.

“Much remains to be done in this type of case, which justice is still struggling to deal with,” she said.

The start of a dramatic spiral

The gear, according to Shaina’s complaint, had started when her boyfriend had taken a photo of her naked and had used it to blackmail her. She had joined him in a disused clinic, where the trio had assaulted her.

Images of the scene posted on Snapchat had earned Shaina, according to her brother, a reputation as an “easy girl” exposing her to “relentlessness” in her city.

On May 1, 2019, she again filed a complaint for having been beaten up by her ex-boyfriend, facts still under investigation. Then on October 25, 2019, a few days pregnant, she was stabbed and then burned alive in a shed in her city. Facts for which another 17-year-old, with whom she had an affair, was indicted.
