It is not the first case in Italy against the Swiss entrepreneur: Stephan Schmidheiny’s family was a major shareholder in an Eternit plant in the Piedmont region in the 1970s and 1980s. Schmidheiny was accused of intentionally killing 392 people. These are said to have died as a result of exposure to asbestos.

An Italian court in Novara has now sentenced Swiss entrepreneur Stephan Schmidheiny to 12 years in prison for the negligent killing of 147 people. While the public prosecutor demanded life imprisonment, Schmidheiny’s defense demanded acquittal.

The fact that asbestos is dangerous to health was already known in the 1930s. For example, asbestos causes asbestosis or asbestos dust lung. In addition, inhalation of asbestos can lead to lung cancer and cancer of the pleura and peritoneum. The use of asbestos has therefore now been banned – in Switzerland since 1990 and in the EU since 2005.

In addition to the twelve years of imprisonment, the court imposed a five-year ban on public offices and set provisional damages of 80 million euros – 50 million euros of which was for the municipality of Casale Monferrato alone, where the Schmidheiny family was a major shareholder in the Eternit plant from 1976 to 1986 .

Schmidheiny’s spokeswoman Lisa Meyerhans argued to the Keystone-SDA news agency that the court in Novara “in its judgment did not fully appreciate the clear evidence of Stephan Schmidheiny’s innocence”. Since the court clearly ruled out intent, “many of the alleged acts” are now statute-barred. According to Meyerhans, Schmidheiny cannot be accused of negligent action, which means that the verdict is “clearly illegal”. The defense announced an appeal against the verdict.
