Millions of messages are sent every day via Messenger WhatsApp. Through the application, images, videos and text messages can be shared with many people. But what about a termination sent via WhatsApp?

As the Bund-Verlag reports, a termination sent as a photo via the news application is not legal, since the written form requirement is not met. This emerges from a judgment of the LAG Munich.

This is based on a case in which an employer terminated the employee. He received a picture of a signed termination without notice via WhatsApp. The employee took legal action against the dismissal. In the first instance, the labor court ruled that the dismissal was invalid.

The appeal lodged by the employer has now been rejected by the LAG Munich in the second instance, stating that an employment relationship can only be terminated by means of a written notice. A photograph of such does not meet the written form requirement according to § 623 BGB.
