The man wore a prisoner costume and a sign reading "Mask makes you free" at a demonstration in the cathedral city in May, as press photos show. Since the man had contradicted the penalty order, the case will now be heard in December before the Cologne district court.
"It's about the interpretation of freedom of expression," said a spokesman. According to the public prosecutor's office, this does not cover the man's behavior. The National Socialists put the cynical slogan "Arbeit macht frei" on the gates of several concentration camps.
