“The multiplication of “green” profit-sharing agreements would respond to the social and environmental emergency”

However, a solution appears immediately mobilizable to both commit companies to carry out an environmental transformation and financially reward the employees who will participate in it: profit-sharing agreements based on environmental criteria.

In a nutshell, the purpose of the profit-sharing agreement is to associate employees collectively with the results or performance of the company. Set up by collective agreement, or subject to threshold conditions by unilateral agreement from the employer, their calculation formulas can incorporate environmental indicators. As the Ministry of Labor points out in one of its employee savings guides, ” social partners [ont] great latitude in establishing the calculation formula”. Thus, they are free to calculate the performance of the company through environmental criteria.

In addition, since a decree of August 20, 2019 implementing the provisions of the Pacte law (Action plan for the growth and transformation of companies), the performance criteria relating to corporate social responsibility (CSR) can also be included in a profit-sharing agreement, whether it concerns the means devoted to the prevention of environmental risks and pollution, measures for prevention, recycling, reuse, recovery and elimination of waste or actions fight against food waste.
