Above all, she is said to have put pressure in the past to bring about the overthrow as soon as possible: the Berlin judge Birgit Malsack-Winkemann, who was a member of the AfD in the Bundestag from 2017 to 2021, was supposed to be in the “cabinet” of Heinrich XIII. The prince, who investigators associate with the “Reichsbürger” scene, and who was arrested today as one of 25 suspects, is said to have had plans to overthrow the state order in Germany and replace it with one of his own. The terrorist group, which is said to also include former soldiers of the Bundeswehr, would have accepted the deaths for the overthrow.

According to the findings of the investigation, Malsack-Winkemann belonged to the so-called “Council” of the terrorist group, which was headed by Heinrich Reuss. The members of the “council” have met regularly in secret since November 2021 to plan the intended takeover of power in Germany and the establishment of their own state structures. As Minister of Justice, the AfD woman would also have had the task of convincing other heads of the judiciary of the goals of the terrorist group.

As a member of parliament, she despised the Bundestag

Malsack-Winkemann is a marksman and, according to “Spiegel”, owns several firearms. In the AfD, she belongs to the officially dissolved extreme right wing around the Thuringian party leader Björn Höcke. In her speeches in the Bundestag, she expressed crude theories. In the summer of 2018, for example, she warned in the Bundestag against migrants with antibiotic-resistant bacteria and infectious diseases and called for all migrants to be quarantined. In the same breath she lamented the exorbitant costs of such a regulation. Malsack-Winkemann looked at the MPs in the plenary hall with undisguised contempt and openly displayed that she considered the Bundestag to be illegitimate.

After leaving parliament, 58-year-old Malsack-Winkemann returned to the Berlin Regional Court. However, the Berlin Senator for Justice, Lena Kreck, doubted that the former AfD deputy could administer justice unbiasedly and that she was true to the constitution. As a result, Kreck tried to put the AfD woman into early retirement by applying to the judge’s service court.

In vain – the court decided that Malsack-Winkemann could remain a judge and justified this with the freedom of speech guaranteed by the Basic Law in the Bundestag. According to the responsible judge, the speeches there should not lead to official prosecutions or other sanctions by the state. Malsack-Winkemann was arrested today. “We will exhaust all instruments to remove the accused completely from the judiciary,” said Justice Senator Kreck.
